 KANO CRISIS: COURT RULED IN FAVOUR OF DEPOSED EMIR, GAINED N10M COMPENSATION



The Federal High Court in Kano ruled on Friday in favor of the deposed Emir of Kano, Alhaji Aminu Ado Bayero, upholding his rights to movement and civil liberty. The court ordered the Kano State Government to compensate him with N10 million in damages.


Justice Simon Amobeda of the Federal High Court 3 presided over the case. He accepted the applicant’s counsel’s withdrawal of certain reliefs, citing their right to do so by law. He first addressed the court's jurisdiction before delving into the main issues, affirming that the court could hear cases related to the abuse of fundamental human rights.


The applicants sought several reliefs, including N5 billion in damages for threats to Bayero’s human rights. Justice Amobeda emphasized the court's duty to protect citizens' rights, noting that the applicant had provided sufficient evidence of these violations.


In 2019, the Kano State Government appointed a new emir, but on May 23, 2024, it announced through social media that Bayero had been deposed and ordered his arrest, giving him 48 hours to leave the palace. Justice Amobeda declared this action a breach of Bayero’s fundamental rights to liberty and freedom of movement as guaranteed by the 1999 Constitution.


The court restrained the Police, DSS, Army, Air Force, Navy, and other authorities from arresting, detaining, or harassing Bayero. Additionally, it ordered the Kano State Government to pay N10 million for breaching his rights to personal liberty and freedom of movement. However, the judge denied the request for the costs of filing and prosecuting the case.
